• The User Data complies with all applicable local, state, national, and international laws, rules, and regulations, including but not limited to data protection laws (such as GDPR, CCPA), privacy laws, and industry-specific regulations
• The User Data does not contain any illegal, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or otherwise objectionable content
• You have the authority to bind your organization (if applicable) to these Terms and to grant the rights and licenses set forth herein

3.3. License to Process Your Data

By uploading User Data, you grant us a limited, non-exclusive, worldwide, royalty-free license to access, use, process, store, and display your User Data solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete your User Data or terminate your account, except as necessary for us to comply with legal obligations or enforce our rights.

4. Indemnification

You agree to indemnify, defend, and hold harmless Incredimaps, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights, privacy rights, or data protection rights
• Any User Data you upload, submit, or transmit through the Service
• Your failure to obtain necessary permissions, consents, or authorizations for User Data
• Any claims that User Data violates applicable laws, regulations, or contractual obligations
• Any unauthorized access to or use of your account
• Your violation of any applicable laws or regulations

This indemnification obligation will survive the termination of these Terms and your use of the Service.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

5.2. No Liability for User Data

WE ARE NOT RESPONSIBLE OR LIABLE FOR THE ACCURACY, COMPLETENESS, LEGALITY, OR CONTENT OF ANY USER DATA. WE DO NOT VERIFY, VALIDATE, OR ENDORSE ANY USER DATA. YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR USER DATA COMPLIES WITH ALL APPLICABLE LAWS AND REGULATIONS AND THAT YOU HAVE ALL NECESSARY RIGHTS AND PERMISSIONS TO UPLOAD AND USE SUCH DATA.

5.3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INCREDIMAPS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Loss or corruption of data
• Cost of substitute goods or services
• Business interruption
• Personal injury or property damage

ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

6. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any applicable laws or regulations
• Upload, submit, or transmit any User Data that violates third-party rights or applicable laws
• Attempt to gain unauthorized access to the Service or any related systems or networks
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service to transmit any viruses, malware, or other harmful code
• Reverse engineer, decompile, or disassemble any portion of the Service
• Use automated systems (bots, scrapers) to access the Service without our prior written consent
• Resell, sublicense, or redistribute the Service without our prior written consent

7. Intellectual Property

The Service, including all content, features, functionality, software, and materials, is owned by Incredimaps and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Data Security and Privacy

We implement reasonable security measures to protect your User Data. All data transmission is encrypted using HTTPS (TLS/SSL), and data stored in our database is encrypted at rest by our hosting provider. We implement access controls and authentication to restrict access to your data. However, no method of transmission over the Internet or electronic storage is 100% secure. 9. Data Deletion and Account Termination
